Introduction

These Terms and Conditions govern your use of the PW HR application and the related service accessible at presensiphillipworks.com, operated by PW HR (Jovan Koswara).

By using this application, you agree to accept all terms and conditions written here. You must not use this application if you disagree with any of these Terms.

Minors or people below 18 years old are not allowed to use this application.

Other than the content you own, under these Terms, PW HR and/or its licensors own all intellectual property rights and materials contained in this application.

You are granted a limited license only for purposes of viewing and using the material contained in this application.

Any user ID and password you may have for this application are confidential and you must maintain their confidentiality.

Your Content

"Your Content" means any audio, video, text, images or other material you choose to display in this application.

By displaying Your Content, you grant PW HR a non-exclusive, worldwide, irrevocable, sub-licensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media, solely for the purpose of operating the service.

Your Content must be your own and must not invade any third party's rights. PW HR reserves the right to remove any of Your Content from this application at any time without notice.

No Warranties

This application is provided "as is," with all faults, and PW HR makes no representations or warranties of any kind related to this application or its materials.

Limitation of Liability

In no event shall PW HR, nor any of its officers, directors and employees, be held liable for anything arising out of or in any way connected with your use of this application.

PW HR shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this application.

Indemnification

You hereby indemnify to the fullest extent PW HR from and against any and all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

Severability

If any provision of these Terms is found to be invalid under any applicable law, such provision shall be deleted without affecting the remaining provisions herein.

Variation of Terms

PW HR is permitted to revise these Terms at any time as it sees fit, and by using this application you are expected to review these Terms on a regular basis.

Governing Law & Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of the Republic of Indonesia, and you submit to the jurisdiction of the courts located in Indonesia for the resolution of any disputes.

Personal Information

We generally collect and process the following types of Personal Information through the PW HR application:

Personal details provided consciously and voluntarily by a Customer (Employer), End User, or the Customer's administrator, or through your use of the PW HR platform.

This may include your name (first and last), birthdate, gender, nationality, job title, phone number(s), the date you first started working for your employer, the department you work in, employee ID, address, country, city, postcode, bank account details (bank name, account number, branch address), termination date, termination reason, status in the system and workplace, IP address, Government ID details, other unique identifiers, information the Customer chooses to collect, and any other information you may choose to provide.

Location Information

If you are using the PW HR employee self-service app, we capture your geolocation for time-keeping purposes. The legal basis for processing this information is the contractual obligation to your employer to perform the Services.

Biometric & Attendance Information

We collect biometric data through our facial recognition feature to record clock in / clock out if the employer has requested face recognition. The face biometric is not used for any purpose other than attendance services.

The registered face is retained while the user is active and requires face-recognition attendance services. Face data is removed when the user is removed by the Account Owner.

The Account Owner may also remove the registered face of any active user if it is no longer required.

We do not share face data with external third parties except the subprocessor required for operating the application and performing user identification services. The subprocessors do not store users' face data after processing has been completed.

We collect attendance and time-entry data when you use the application. The legal basis for processing this information is the contractual obligation to your employer to perform the Services.

Device Information

When using the PW HR application, we may request access to your device's camera and photo storage. This allows you to take and upload pictures, and such access is only used in ways you choose.

You may revoke these permissions at the device level at any time. We do not access your camera or photo storage without your permission.

When you download and use the application, we automatically collect device information such as operating system version, device type, and hardware usage statistics. The legal basis for processing this information is the contractual obligation to your employer to perform the Services.
